Environmental Liability

Each of our actions can have an impact on the environment and human health. The European Enlia Directive aims to regulate this responsibility for companies in order to prevent and reduce environmental damage. Seven European partners, including the University of Le Havre through the participation of researchers from UMR-I 02 SEBIO and LexFEIM laboratory, have decided to work together to analyse practices and improve the implementation of the directive.
The objective of the Environmental Liability Directive 2004/35/EC (ELD) is to reduce and prevent environmental damage by penalising damage caused by various professional activities and requiring that it be repaired.
A major problem with the ELD is that it is not binding, which means that it is underused in practice. Many operators are unaware of their potential liability for environmental damage.
The transposition of the ELD into the regulatory frameworks of the various European countries has been uneven. There are a large number of different models with highly variable levels of development. In the countries applying for membership of the European Union, transposition is still ongoing.
In this context, the ENLIA project aims to act as an accelerator for environmental policies in Europe, in order to strengthen the development of environmental liability and, above all, to promote its practical application.
SEBIO is responsible for analysis and acts as an advisor to the other partners.
